CMWeb (hereinafter "we", "us", or "our") operates an internet streaming interface and digital media access engine. We respect intellectual property and are committed to complying with the provisions of Title 17 of the United States Code, Section 512, commonly known as the Digital Millennium Copyright Act (DMCA).

1. Requirements for a Compliant Notice

Pursuant to 17 U.S.C. § 512(c)(3), an actionable takedown notice must include all of the following:

• A physical or electronic signature of a person authorized to act on behalf of the owner of the infringed exclusive right.
• Identification of the copyrighted work claimed to have been infringed, or a representative list of such works.
• Identification of the material claimed to be infringing, with information sufficient to permit CMWeb to locate the material (exact URLs or content identifiers).
• Contact information of the complaining party, including full legal name, physical address, telephone number, and email address.
• A statement that the complaining party has a good faith belief that the use of the material is unauthorized.
• A statement, under penalty of perjury, that the notice is accurate and that the complainant is authorized to act on behalf of the copyright owner.

2. Repeat Infringer Policy

Pursuant to 17 U.S.C. § 512(i)(1)(A), CMWeb implements and strictly enforces a repeat infringer policy. We maintain an audit ledger of takedown notices and will terminate, in appropriate circumstances, the accounts, IP addresses, or network privileges of users or feed distributors who repeatedly infringe intellectual property rights.

3. False or Misleading Claims

If your content or feed link was removed or disabled as a result of a DMCA takedown notice and you believe this was due to mistake, misidentification, or that you hold legitimate authorization (or fair use protection), you may submit a formal counter-notification.

Required Elements of a Counter-Notice

• Your physical or electronic signature.
• Identification of the material that has been removed or disabled, and the location at which it previously appeared.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your full name, physical address, telephone number, and email address.
• A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which CMWeb may be found), and that you will accept service of process from the person who provided the original takedown notice.
